Terms & Conditions
PLEASE NOTE: Rates are subject to change and do not include travel expenses where applicable. Savannah Ruth Photography has the right to refuse service for any booking which she does not want to render.
RETAINER & FEES: A 50% non-refundable retainer is required to book your session. Deposits are due within 24 hours of scheduling your session, unless we’ve made other arrangements. No session will be considered booked until a deposit is received. The remaining balance must be paid prior to or before the start of the photo session on the day of. Your session fee deposit and payments can be made in the form of cash, debit/credit card or Apple/Google pay. Checks are not accepted. All fees are paid through our invoicing system. Additional goods ordered must be paid for in full at the time of ordering.
ADDITIONAL EXPENSES: No travel mile expenses are charged for shoots up to a 30 mile round trip from the Photographer’s location from Eden, NC 27288. Some packages will include a higher mileage allowance and it will be listed in the "What's Included" under the service description. Additional mileage beyond the included will be charged to the Client at the rate of $1.00 per mile. If the portrait session is taking place on location, any entrance fees, parking fees or related expenses will be payable by the Client.
BOOKING POLICY: A 50% non-refundable retainer is required to hold your date and time, unless we’ve made other arrangements, as well as full acceptance of the terms and conditions as published on the photographer's website. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due. Appointments made without a deposit may not be honored and are subject to cancellation. Session end times will not be extended to accommodate client lateness.
The client understands that their session is not confirmed until the 50% retainer is paid. Weather cancellations will be made at the photographer's discretion. Tardiness will not delay the session. The photo session will remain within the scheduled time frame. If I need to reschedule I will give contact within 24 hours of said reserved session date, otherwise I forfeit transfer of my retainer for a new session date.
TARDINESS: Session end times will not be extended to accommodate client lateness. Please plan enough time to get to your session. Whether that be getting the kids ready or navigating through rush hour traffic. If you are running late, please call me. We respect every single client's time and put an incredible amount of effort into scheduling and planning a session. If you have a 60 minute session scheduled and you are 20 minutes late, you will then have a 40 minute session. I will still make an effort to deliver the number of pictures in the package but the delayed time can affect the number of pictures we deliver. If you are more than 30 minutes late without calling, you will forfeit your booking fee and we will have the right to cancel the session. If you no call no show, you are forfeiting your booking fee and will have to restart the booking process. We of course understand unforeseen circumstances such as illness or accidents. If we are late, we will communicate that with you and your session time will not be affected.
CANCELLATION POLICY: If you are unable to make your photo session all deposits will act as a cancellation fee. 72 hours of advance notice of cancellation is required to credit the deposit towards a future session. You have one reschedule allowed and you must contact us via email at savannahruthphotography@gmail.com to reschedule your session. The photographer reserves the right to deny service to any client(s) who repeatedly have a history of cancellations.
PROOFS & DELIVERABLES: Once your session is complete, we’ll narrow down your images to a workable number and deliver proofs (i.e., unedited, unretouched images) from which you’ll choose your final images for retouching. The number of the proofs and final images we deliver depends on the package you purchased. Additional edited images are available for purchase at $5 for each picture beyond the package amount agreed. We do not release proofs or RAW images. We always deliver final images as high resolution JPGs. No images, including proofs, will be delivered until your full fees have been paid.
CREATIVE LICENSE, COVERAGE AND REPRODUCTION: The Photographer will be responsible for creative choices in terms of the images captured during the shoot, but will take into account the Client’s reasonable instructions in respect of the shoot brief.
Special requests are not binding instructions, although every effort is made to comply with the client's wishes. The Photographer/s will do their best to honor the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangements due to changes in weather an the availability and willingness of subjects.
RETOUCHING: All images will be adjusted for exposure, brightness, contrast, sharpness, etc. The Photographer’s judgment regarding these corrections and the number of images put forward to the Client shall be deemed correct. Retouching, digital manipulation etc is available to the Client as an option at extra cost.
TURNAROUND: Depending on the time of year and the scope of your shoot, you can expect proofs 10 days - 2 weeks after your session. Retouched images are usually delivered 10 days - 2 weeks after you've made your selections. Schedules may vary so please confirm delivery times when booking your session.
EXPIRATION OF PROOFS: Proofs are available for 90 days from the date we send your link. After 90 days, your proofs will be archived. There’s a $50 fee to reopen archived galleries.
FOR PARENTS OF YOUTH CLIENTS: We require a parent or guardian to be present for all shoots with kids under 18 years old. There are no exceptions to this policy. We ask that parents and guardians stay out of the model’s eye line and do not coach your kid. If you would like to take pictures of your kid’s session with your phone, please ask permission before you start snapping.
SOCIAL MEDIA: We encourage posting of final (retouched) images on social media but we require that citation of photographer be made. The client agrees that they will under no circumstances alter any photographs that are placed in public on the internet. The client agrees to be responsible for any family member or friend who posts our photographs online and agrees that they cannot be cropped (with the exception of the forced cropping for Facebook’s Timeline), altered in color, or edited in any way.
MODEL RELEASE: I have read and agree to the following statement: I commission Savannah Ruth Photography, the photographer, to photograph myself and/or my spouse and/or underage children. I hereby grant and understand that Savannah Ruth Photography may use and publish all photographs, pictures, portraits or images described above in any and all forms of media and in all manners including composite images or distorted representations for the purposes of publicity, illustration, commercial art, advertising, publishing (in both hard and soft formats) and any lawful uses as we may determine and there will be no compensation for the above. By agreeing to these terms you acknowledge you have the right to do so and indemnify us of any litigation arising out of such use.
INDEMNIFICATION: If Savannah Ruth Photography cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return the retainer fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or other media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.
LIABILITY: All talent and guardians release Savannah Ruth Photography and all affiliated persons and all location owners of any liability, injury or damage that may happen during the photo shoot.
COPYRIGHT: The copyright of photographs remains with the Photographer. The Photographer grants the Client permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Publication, Entry to awards or any Commercial use of the photographs is not allowed without prior written permission from the Photographer. The Client hereby allows the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, social media, sample albums etc.
CHANGES TO OUR PRIVACY POLICY: If we decide to change our Terms & Conditions, we will post those changes on this page. These Terms & Conditions were last modified on 05-NOVEMBER-2023.
